This document is the whole of the permission granted for the Work, and it grants almost none. Read it as a notice rather than an invitation: it says what is owned, what may not be done with it, and how to ask. 1. THE WORK "The Work" means everything published as Pandalers: the website and every copy or mirror of it, the source code and the compiled builds, the visual design, the written content, the collection of pandal records and the geographic data compiled into it, and every photograph published on it. 2. OWNERSHIP Copyright and every other right in the Work belong to Tanumoy Maity, who publishes under the name IndoGeek ("the Owner"). The Work is not open source. No part of it is offered under any public licence, and no licence is granted by implication, by estoppel, or by the act of publishing it. 3. WHAT MAY BE DONE The Work may be read and visited, and used as a visitor for the purpose it was made for: finding pandals, planning routes, and recording your own visits in your own browser. That is all that is permitted. 4. WHAT MAY NOT BE DONE Without the Owner's prior written permission, it is not permitted to: a. copy, reproduce, mirror, or republish the Work, or any substantial part of it, on a website, in an application, or in a distribution; b. modify, adapt, translate, or create derivative works from the Work; c. distribute, sublicense, sell, rent, lease, or otherwise make the Work available to anyone else, whether or not for money; d. deploy the Work, or any part of it, as your own product or as part of one; e. scrape, crawl, bulk-download, or otherwise extract the pandal records, the photographs, the written content, or any other data from the Work, or use any of it to build or train a model, dataset, index, or product; f. remove, obscure, or alter any copyright notice, licence text, attribution, sign-in, or credit appearing in the Work; g. present the Work, or any part of it, as official, endorsed by, affiliated with, or connected to the Owner when it is not. 5. TRADE NAMES AND MARKS The name "Pandalers", the Pandalers wordmark and logo, the domain names and accounts used by the Work, and the phrase "Kolkata Pandal Hopping" as used to identify it, are marks of the Owner. No permission is granted to use any of them for any purpose. In particular, they may not be used, and neither may any name or mark confusingly similar to them, in the name of a website, application, product, service, organisation, account, or repository, or in any way that suggests the Owner's sponsorship or approval. This restriction stands on its own: it applies even to a part of the Work that may lawfully be held under another provision. 6. WHAT VISITORS CONTRIBUTE A photograph you upload stays yours. By uploading it you grant the Owner a worldwide, perpetual, irrevocable, royalty-free licence to store, display, resize, and distribute that photograph as part of the Work, and you confirm that you own it or have the right to publish it. Contributing does not transfer ownership of any other part of the Work, and nothing you contribute changes these terms for anyone else. 7. THIRD-PARTY COMPONENTS AND DATA This licence covers the Work only. The software libraries it depends on, the map tiles and imagery it displays, and the third-party data it incorporates (OpenStreetMap contributors' data among it, published under the Open Database Licence) stay under their own licences and copyright, held by their own authors. Nothing here narrows any right you already have under those licences. 8. NO WARRANTY THE WORK IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. Pandal names, dates, locations, timings, ratings, and crowd expectations are compiled from published listings, are not official, and may be wrong. 9. LIMITATION OF LIABILITY TO THE FULLEST EXTENT PERMITTED BY LAW, THE OWNER IS NOT LIABLE FOR ANY CLAIM, DAMAGE, LOSS, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE WORK OR ITS USE. Where liability cannot be excluded, it is limited to the greater of the amount paid for the Work, which is zero, and one hundred Indian rupees. 10. TERMINATION Any breach of this licence ends the permission to use the Work immediately, and any copy held must then be deleted. The Owner may also withdraw permission at any time, in writing and for any reason. Sections 2, 4, 5, 8, 9, 11, and 12 survive termination. 11. ENFORCEMENT AND INDEMNITY The Owner intends to enforce this licence. You agree to indemnify the Owner against any claim, loss, or expense, including reasonable legal costs, arising from your use of the Work or your breach of these terms. A breach of Section 2, 4, or 5 may cause harm that money cannot repair, so the Owner may seek injunctive relief in addition to damages. 12. GOVERNING LAW AND JURISDICTION This licence is governed by the laws of India, and the courts at Kolkata, West Bengal have exclusive jurisdiction over any dispute arising from it. If any provision is held unenforceable, the rest stands. Any permission granted under an earlier version of this licence is replaced by this one.
